They needn't have bothered. In the lawsuit in the Netherlands, the judge 
ruled that, because Apple's design is so minimalistic, a competitor 
would have to artificially cripple his product in order to differentiate 
it enough. Therefore, this cannot be reasonably expected of that competitor.

In other words, because Apple's design is so generic, it disqualifies 
itself as being something special, protected by the various intellectual 
property and plagiarism laws.
